Evaluation of "Carve-out" Agreements in Workers' Compensation
Several states have enacted legislation that allows management and labor to collectively bargain alternatives to the current workers compensation system. Alternate dispute resolution (ADR) mechanisms are a major focus of current research in many areas including medical care and benefit delivery. California is the leader in this area of research and is the center of intense debate on the future of this innovation. A mix of case studies, surveys, and focus groups is being used to describe the implementation of the ADR process. A quantitative methodology will be developed for measuring the impact of "carve-outs" in California and nationally for a proposed subsequent phase of the project.
